3. Purpose of Processing
Your personal data is processed exclusively for: (a) responding to your project inquiries, (b) delivering requested services, (c) sending project-related communications, and (d) maintaining statutory business records as required by French and EU law.
4. Legal Basis
Processing is based on Article 6(1)(b) of the GDPR — performance of a contract or pre-contractual steps — and Article 6(1)(f) — legitimate interest in responding to business inquiries.

Contact form submissions are retained for 24 months from the last interaction. Contract-related data is retained for 5 years in compliance with French commercial law (Code de Commerce). Analytics data is anonymized after 12 months.

Terms of Service
1. Scope of Agreement
These Terms govern all services provided by WebDesignForges, including web design, UI/UX architecture, visual hierarchy engineering, and related consulting services. Services are delivered as described in individual Statements of Work (SOW) or project proposals.
2. Project Proposals & SOW
Each project begins with a detailed proposal outlining scope, deliverables, timeline, and pricing. Upon client acceptance, this proposal constitutes a binding Statement of Work. Any scope changes require written agreement and may affect pricing and timeline.
3. Pricing & Payment
All prices are quoted in EUR or USD as specified in the proposal. Invoices are payable according to the schedule defined in the SOW, typically 50% upon project initiation and 50% upon delivery. Late payments incur a 1.5% monthly interest charge as permitted under French commercial law.
4. Intellectual Property
Upon full payment, all intellectual property rights in the delivered work product — including source code, design files, visual assets, and documentation — are transferred to the client. WebDesignForges retains the right to display the work in portfolios and case studies unless explicitly declined in writing.
5. Delivery & Acceptance
Deliverables are provided via digital transfer. The client has 7 business days from delivery to review and request reasonable revisions. Silence beyond this period constitutes acceptance. Revisions beyond the agreed scope are billed at the standard hourly rate.
6. Liability
WebDesignForges liability is limited to the total value of the relevant project SOW. We are not liable for indirect, consequential, or incidental damages arising from the use of delivered work products.
7. Termination
Either party may terminate the agreement with 15 days written notice. Upon termination, the client pays for all work completed to date. Pre-paid amounts for undelivered work are refunded within 30 days.
8. Governing Law
These Terms are governed by the laws of the French Republic. Any disputes shall be submitted to the competent courts of Versailles, France.
Refund Policy
1. Project Deposits
The initial 50% deposit is non-refundable once project work has commenced, as it covers planning, research, and resource allocation. If cancellation occurs before work begins, a full refund of the deposit is issued within 14 business days.
2. Completed Milestones
Payments for completed and accepted milestones are non-refundable. If a milestone deliverable does not meet the specifications defined in the SOW, we will provide reasonable revisions at no additional cost within 14 business days of the delivery date.
3. Final Delivery
The final payment is non-refundable upon client acceptance of the deliverables. If the client fails to respond within the 7-day review period, the deliverables are considered accepted.
4. Retainer Services
Monthly retainer services may be cancelled with 30 days written notice. Pre-paid retainer months that have not been used are refunded on a pro-rata basis. Used retainer hours are non-refundable.
5. Dispute Resolution
Refund requests should be directed to [email protected] with a detailed description of the issue. We commit to responding within 3 business days and resolving disputes amicably whenever possible.
6. Statutory Rights
Nothing in this policy affects your statutory rights under French consumer law (Code de la Consommation) and EU consumer protection directives.
